(FLORIDA) – A single mother in her late twenties, our client was staring down a sizable debt from her marriage, which had ended years ago. Credit card loans, medical debt, car fees, and other large expenses had racked up a deficit to the tune of nearly $80,000.
These expenses had been shared between the client and her ex-husband, who had a history of emotionally, sexually, and financially abusing the client. In keeping with this behavior, he had independently filed for bankruptcy, without adding our client to the paperwork. The remaining debt was hers to pay, despite not having the means.
The client came to Florida Rural Legal Services (FRLS) seeking solutions. FRLS is a non-profit law firm that provides free civil legal aid to qualified individuals, families, and vulnerable communities across 13 Florida counties and to farmworkers statewide. FRLS attorneys provide free legal services to low-income clients for a range of consumer law issues, like filing for bankruptcy.
A FRLS attorney began to parse through the client’s financial and legal documents, assessing the best route forward based on the client’s unique circumstances. Determining that filing for Chapter 7 bankruptcy, also called liquidation bankruptcy, was the right fit for the client, our team successfully navigated the client through the process.
Through Chapter 7, the client’s debt was discharged by the bankruptcy court, offering the client a fresh start.
