(FORT MYERS, Fla.) — Florida Rural Legal Services (FRLS) has successfully recovered back wages and essential identification documents for a group of H-2A farmworkers who were exploited by their employer. The case, handled by an outreach paralegal at FRLS in collaboration with a local agent from the Department of Labor's Wage and Hour Division, highlights the persistent issue of labor trafficking and exploitation within Florida's agriculture industry.
The guestworkers, who came to the United States under the H-2A visa program, were victims of wage theft and had their identification documents, including H-2A visas, Mexican IDs, and social security cards, unlawfully confiscated by their employer. This exploitation left the workers vulnerable and unable to access their legal rights and protections.
FRLS's intervention ensured that the workers received the full wages they were owed. Critically, the legal aid also secured the return of their confiscated IDs and documents. This outcome not only restored the workers' legal standing but also protected them from further abuse and exploitation.
"By intervening swiftly, FRLS protected these H-2A workers from further abuse and injustice," said a spokesperson from FRLS. "Holding employers accountable for wage theft and document confiscation safeguards guestworkers' basic rights and prevents conditions that can enable labor trafficking."
Florida has the highest rates of human trafficking in the nation, with countless guestworkers preyed upon by unscrupulous employers after arriving to work on the state's farms.
